Class action: Successfully certified a class action with s. 15 Charter implications
Mandate
Metro Taxi Ltd. v. City of (Ottawa), 2018 ONSC 509
Successfully certified a class action against the City of Ottawa on behalf of four taxi brokers with licenses in Ottawa and 768 taxi plate licensees with respect to the City’s enforcement and amendment of its Taxi By-laws from 2012-2016 with the entry of Uber into the Ottawa market. Common issues also include that, contrary to section 15 of the Charter, the City’s conduct discriminated against license holders, of whom over 90% are members of minority groups, such that the license holders are entitled to Charter damages.
